Terms of Service

By downloading, installing, or using On-Device Note Taker ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

On-Device Note Taker is a macOS application that allows users to record, transcribe, and organize notes using on-device AI processing. The App provides:

• Audio recording from microphone and system audio sources
• Real-time transcription using Apple Intelligence
• AI-powered summaries and action item extraction
• Interactive chat with meeting content
• Speaker identification and color-coding (Preview)
• Full-text search across all notes
• Export to Markdown, text, and JSON formats
• Audio file import and processing

The App requires:

• macOS 14.0 (Sonoma) or later for full AI features
• Apple Silicon (M1 or later) for Apple Intelligence functionality
• Microphone access for audio recording
• Sufficient storage space for audio recordings and transcripts

The App is licensed, not sold. Your license includes:

• One-time purchase for personal use
• Installation on all Macs you own or control
• Unlimited recordings and transcriptions
• Free software updates and new features

You may not redistribute, resell, or sublicense the App.

The App operates with complete privacy:

• All recordings and transcriptions are processed entirely on your device
• No personal data or content is transmitted to external servers
• AI processing uses Apple Intelligence running locally on your Mac
• All data is stored locally and protected by macOS security
• No analytics, telemetry, or tracking of any kind

The App may request the following permissions:

• Microphone Access: Required for recording audio
• Screen Recording: Optional permission for capturing system audio from video conferencing apps
• File System Access: Optional permission for importing audio files and exporting transcripts

You can revoke these permissions at any time through macOS System Settings.

You are responsible for:

• Legal Compliance: Ensuring you have permission to record conversations in your jurisdiction
• Consent: Obtaining consent from meeting participants before recording
• Appropriate Use: Using the App for lawful purposes only
• Data Backup: Backing up your recordings and transcripts if desired
• Storage Management: Managing disk space for recordings

The App is provided "as is" without warranties of any kind. We are not liable for any damages arising from the use of the App, including but not limited to:

• Transcription accuracy or completeness
• Speaker identification errors
• Recording failures or audio quality issues
• Data loss or corruption
• Storage limitations or disk space issues
• Compatibility with third-party applications
• Legal consequences of recording without proper consent

The App uses Apple Intelligence to generate summaries, action items, and chat responses:

• AI-generated content may not always be accurate or complete
• You should review AI-generated summaries for accuracy
• We are not responsible for decisions made based on AI-generated content
• AI features require compatible hardware and macOS versions

The App is distributed through the Mac App Store and follows Apple's refund policies. Refunds are available within 14 days of purchase if you are not satisfied. Contact Apple Support through the App Store for refund requests.

We may update the App and these Terms from time to time. Continued use of the App after updates constitutes acceptance of any changes. Major updates and new features will be distributed through the Mac App Store at no additional cost.

You may stop using the App at any time by uninstalling it from your device. Your recordings and transcripts will remain on your Mac until you delete them. These Terms will remain in effect until terminated by either party.

The App uses Apple Intelligence, which is subject to Apple's own terms and privacy policy. While all processing happens on your device, you should review Apple's terms for their AI services.
